Definitions
This EULA constitutes a legally binding agreement between Alex Lescieux and you, the licensee (whether an individual or an organization acquiring the license or designated as the license owner upon purchase). By purchasing, downloading, installing, or using the font software (referred to as “the font”), you acknowledge that you have read, understood, and agreed to the terms outlined in this agreement.
This agreement defines the terms and conditions under which the font software is licensed to you by Alex Lescieux. As the licensee, you are granted a non-exclusive, non-transferable right to use the font software solely for the purposes specified in this agreement. This license does not transfer ownership of the font design or any other intellectual property rights associated with it. Any usage beyond the scope defined herein requires explicit authorization.
Principles
The licensing principles of Alex Lescieux are based on a core concept: the value of a typeface is tied to the size of the company using it, measured by the total number of employees. Our goal is to create a fair and transparent relationship between creators and the companies benefiting from the typography. The license owner is always the end client — the company using the font for its public image, visual identity, and communications. Designers or agencies working on a project do not own the license; however, they may use trial versions to test or present the project to their client. Once approved, the client or the designer must purchase a license in the client’s name.
Company Size
We believe that larger companies derive more value from the same typefaces, so the cost of the font license depends on the size of the company using it.
Company size is determined by the total number of employees working within the organization, including all offices, subsidiaries, or locations under the company’s control. This is the only relevant metric for font licensing. Information such as numbers of users, computers, or web traffic is irrelevant for licensing. Please ensure that you select the appropriate license based on the total number of employees within your company.
License Owner
The license owner is the company or entity that uses the font(s) for its public image, branding, and communications. The license always belongs to the company using the fonts, not to the designer, agency, or any other third party acting on the company’s behalf. This means that when a designer or agency purchases a font, they do so on behalf of the client, and the license must be in the client’s name.
The license owner must ensure that font use complies with this agreement, including the scope of usage, the company size measured by the number of employees, and the license type. If a project extends beyond the scope of the original license (for example, if the company grows or if additional usage is needed), the license owner must purchase the necessary upgrades or extensions.
First Designer
The first designer or studio who uses the fonts to create things for the License Owner (i.e., the “First Designer”) is covered by the License Owner’s license. If the License Owner wants to allow additional third parties to use the fonts, they must purchase a Subcontractor add-on.
Subcontractors
If the License Owner wishes to allow any third parties other than the First Designer — such as freelancers, agencies, external designers, developers, producers, printers, PR agencies, etc. — to access or use the fonts on their behalf, the Subcontractor Add-On is required at the time of the initial license purchase.
Please note: the subcontractor add-on cannot be added retroactively. If the License Owner later decides to involve additional third parties without having included this add-on in the original license, a new and updated license will be required.
License Types
We offer various licensing options to meet different font usage needs:
Desktop/Print
Allows the installation of the font(s) on all designated devices to create printed and digital materials (documents, merchandise, signage, portfolios, etc.) for a single entity.
Web
Permits the use of the font on one or multiple web domains, with no traffic restrictions. Only web font formats (WOFF, WOFF2) are allowed under this license; desktop fonts like OTF cannot be used for web.
App/Game
Allows the embedding of the font(s) in one app or game (mobile, desktop, web). Additional licenses are required for multiple apps or games.
Video
Permits the use of the font(s) in animated content, such as films, clips, advertisements, streaming, digital billboards etc., for one entity. A video license and a social media license are required for social media video content.
Social Media
Allows the creation of design elements for use on social media platforms (Instagram, Facebook, TikTok, etc.) for one entity. A video license is also required for video content.
Logo/Wordmark
Allows the use of the font(s) to create a logo or wordmark for one entity. Additional licenses are needed for logos for other entities.
If the available formats or license types do not meet your needs, additional license extensions may be necessary. For example, an “Unlimited License” can be provided, granting access to all available usage rights for a one-time fee, with no restrictions on company size or scope of use. Trial Fonts
Selecting the right font can take time, which is why we offer free trial versions. These trials are designed to help you explore options and finalize your selection before making a purchase. They are strictly for testing, exploration, or client presentations and cannot be used in final designs, published materials, or commercial projects without the appropriate license.
Our trial versions provide the full character set, allowing you to conduct tests and present your results to clients.
Once the project is approved, a license in the client’s name must be purchased for any use of the font(s). Note that the use of these trial files is linked to the name and email provided during the download process.
Discounts
We offer discounts to non-profit organizations, as well as cultural and educational institutions. If you qualify, you can purchase fonts at a special discounted rate of 25%. If you’re not sure whether you’re eligible, please contact us at mail@alexlescieux.com.
Payment
A designer or agency can make the payment on behalf of their client, but the license ownership always remains with the company using the font for branding or communication. The license owner’s name is required during the payment process.
Upgrades
The licenses provided cover most standard use cases. If you’re working on a large-scale project, ensure you purchase all necessary licenses. If you exceed the limits of your current license, you’ll need to upgrade by purchasing the required extensions. If you wish to upgrade from a single style to the full font family or if your company grows and requires a license suited to its new size, please reach out to us via email for further details.
Students
As former graphic design students, we understand that students often lack the funds or willingness to pay for licenses for school projects. Therefore, since there is no final client, only presentations to professors and colleagues, students can simply use the available trial versions for their work. This allows students to use the fonts for school projects, self-initiated works, or designs commissioned by the students (e.g., promotional materials for student events). It also allows sharing visuals of printed items created with our fonts (e.g., photos of posters or publications) publicly on social media. However, students cannot use the fonts for personal websites or for creating content on social media. If the student already has clients, those clients must purchase the appropriate license. For any usage beyond these conditions, a full license must be purchased.
Refunds
All sales are final. Fonts are non-returnable and non-refundable. If a font file is defective, please notify us by email within 30 days of purchase, and we will provide a suitable replacement. Refunds will not be issued for incorrect license purchases.
Rights
This contract governs all uses of fonts provided by Alex Lescieux. By using these fonts, you automatically agree to the terms outlined in this agreement. Once full payment of all applicable fees has been received and the license owner, along with any involved sub-contractors, has agreed to comply with the terms of this contract, Alex Lescieux grants the license owner a perpetual, worldwide, non-exclusive, non-transferable, and non-assignable license to use the fonts solely for the purposes specified in this agreement.
The fonts will be delivered once the payment has been processed in full. Alex Lescieux retains full ownership of the fonts, as well as all intellectual property rights associated with them. The license owner may use the fonts in accordance with this contract but does not own the fonts themselves. Any rights not explicitly granted in this agreement remain reserved by Alex Lescieux.
Restrictions
The following actions are prohibited in relation to the use of Alex Lescieux fonts:
Modifying, decompiling, disassembling, or reverse-engineering the fonts.
Creating new fonts based on the design of our fonts.
Altering the font names in a way that violates others’ rights.
Embedding the fonts in a manner that allows end users to access them.
Distributing the fonts without providing a copy of this agreement.
Using the fonts or font designs for training artificial intelligence.
Uploading the fonts to public servers.
Storing the fonts in public repositories.
Critical Uses
We are committed to how our typefaces are used. Any use of our fonts to promote hate, racism, or any form of discrimination is strictly prohibited. Additionally, any design created for political purposes must receive prior written approval before being published.
Taxes
The license owner is responsible for any applicable taxes in their jurisdiction, including withholding taxes if required. Alex Lescieux is not responsible for these payments, and they will not be deducted from any license fees.
Warranties & Liability
The font(s) are provided on an “as-is” basis, without any warranties, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, performance, or non-infringement. The license owner represents and warrants that they have the right to enter into this agreement and guarantees that the use of the fonts will not cause harm, violate any law, or infringe upon the rights of any third party.
By entering into this agreement, the license owner agrees to indemnify and hold harmless Alex Lescieux, along with any affiliates, partners, or licensees, from any loss, liability, damage, or expense (including reasonable legal fees) resulting from a breach of the license owner’s obligations, representations, or warranties.
Neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from this agreement. The total liability of Alex Lescieux will never exceed the amount paid by the license owner for the license. While every effort has been made to ensure the fonts function correctly across a range of systems, perfect compatibility with all legacy or cutting-edge technologies cannot be guaranteed. If you encounter an issue, please reach out.
Final Terms
This agreement constitutes the entire understanding between Alex Lescieux and the license owner, superseding any prior agreements or discussions. Modifications to this contract are only valid if agreed to in writing by Alex Lescieux. The terms of a purchase order cannot alter or amend this agreement.
If any provision of this contract is deemed unenforceable, the remainder of the agreement shall remain in effect, and the unenforceable provision will be replaced with the closest enforceable equivalent. A waiver of any right or condition in this contract does not constitute a precedent for future waivers.
This agreement is governed by Swiss law, with exclusive jurisdiction in Switzerland. Any legal disputes will be handled in Switzerland. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this contract, nor do any conflict of law principles.
End of Agreement
By accepting this license, you agree to adhere to all terms outlined in this agreement.
